Water Wars Southwest of Taos

 A gentleman/farmer/cattleman is alleged to be misusing his irrigation head gate similar to the one you see below. He has four ponds on his property that he is filling up with precious water from a dwindling snow melt source.

Cody Hooks wrote about this 2 years ago and the water hogging issue is far from being resolved. The New Mexico Rural Water Association (NMRWA) is tasked with the oversight and regulation of the water supplied by the Rio Santa Barbara. 

Citizen Ray Gallegos has done his part in publicizing the water theft in Penasco. I believe I heard an interview with the aggrieved citizen on NPR conducted by a Miss Mendoza. A Mr Andy Martinez is the mayordomo(in English that is a steward of natural resources) of the Santa Barbara ditch.

Apparently the steward of the vital livestock sustaining water has had no luck with the alleged perpetrator Armando Sanchez. There are some reports of the accused being combative and armed. In Armando's defense, his property seems to be positioned ideally to get "extra H2O" at bottom of valley. 

Gallegos insists that Sanchez divert pilfered water via headgate back into Rio Santa Barbara where is can be shared in a fair and equitable fashion. It may take Governor Grisham to apply the necessary force on this contentious problem based on human greed and disregard for the needs of their fellow agriculturists.

    The Supreme Court is set to rule regarding disputes across the country over water from rivers that feed farms and fisheries. Law professor Robin Kundis Craig babble from his Ivory Tower in Utah about theoretical and impractical legal precepts.

    1. Robert Nott covered the water disputes between the two states mentioning the concerns of politician Peter Wirth, D-Santa Fe, regarding Elephant Butte crisis.

      The fighting over water is a result of the complexity of the Rio Grande Compact of the late 1930s which created water usage agreements between the states of Colorado, New Mexico and Texas

    2. Robin is not a he. She is a legal scholar scholar. If you do not believe me, the read excerpts from the book Modern Water Law. She does not babble. Not sure why you have a grievance with her. Did you fail one of her law school classes. THE PROBLEM IS YOU NOT HER!
