Homeowner's Tree dangerously Blocking Stop Sign

As I far as I know code enforcement has contacted the female you see in the picture below regarding a huge front yard tree that is blocking a stop sign at a busy four way intersection.

She would be in violation of laws dealing with obstructing traffic signs in any other city. She resides at 113 West Deming Zip code 88203 in Roswell New Mexico. You can see how dangerous her uncut and untrimmed huge tree is at the corner of South Richardson and Deming in the picture below.
I am sure she has received a lot of stimulus money as well as unemployment payments from Uncle Sam so I know she has the cash to cover the costs of cutting the hazardous tree down to size!! I worked for code enforcement in Midland Texas and they would have warned this homeowner once and the then fined her for neglect and threatening the general welfare of the public. I was going to apply for job in Roswell, but will find another place to live if the city has people who care so little for their fellow citizens!!!

It is an easy personal injury lawsuit to win against Chaves County if somebody is injured in car crash due to this negligence.

  1. Joseph Fuentes lives there. The whining woman in the picture must be his wife.

Joe knows that No person shall maintain, plant or permit to remain on any private or public premises situated at the intersection of two or more roads, streets or alleys in the town any hedge, tree(huge overreaching tree), shrub or other growth which may obstruct the view of the operator of any motor vehicle, pedestrian, or hanidcapped person in wheelchair approaching such intersection.

Evelyn Lusignan points out that homeowners can be incarcerated for branches covering up stop signs or yield signs as Fuentes is doing.

Kennewich, Washington residents are keenly aware of the irresponsible , careless and thoughtless people who would allow this dangerous situation to continue. Unless the WOMAN IN THE PICTURE is blind, she just DOES NOT GIVE A CRAP!!!!!!

The wife you mentioned is Delma Fuentes. Delma has no business taking videos of people who are gathering evidence she is violating the laws in alien city.

Bettie Cross could teach Mrs Fuentes a few things about obeying the law and not threatening the lives of each motorist who crosses the intersection of South Richardson and Deming. Delma's house is located on the northeast corner. I will send this link to Bill Bartlett. who is the Supervisor of Code Enforcement down the street at Address 421 N Richardson.

I think Delma is a strong Christian and knows she is wrong for not trimming the tree to where it does not obscure the view of the Red hexagonal Stop sign!!!!!!

    2. There could be an easy class action lawsuit against the Fuentes family for ENDANGERING THE LIVES OF EVERY MOTORIST WHO can not see the stop sign because the homeowners dont want to pay the money to cut down that DAMN LIFE THREATENING TREE.

Speaking of class action litigation, all those nurses in The Woodlands Texas who are filing lawsuit against Methodist Hospital should be fired for putting their personal needs above the patients they are supposed to be CARING FOR!!

SHOULD ALL HAVE THE LICENSE AS MEDICAL PROFESSONALS REVOKED for asymptomatically spreading Corona to the patients they are entrusted to nurture back to health!!!! It all starts with that stupid governor of Texas who has ignored the COVID protocol!!!!!

  2. “It’s not being kept up to code,” said neighbor Larry Hawley.

“It’s awful, it’s awful, these people and the city do not care if the big ass tree kills somebody” said Tanya Santillanes.

These are the words of Albuquerque New Mexico residents who are pissed off that city leaders are DOING NOTHING to protect law abiding people from negligent home and property owners.

Rachel Knapp's marvelous investigative reporting is to be commended!

The standard nation wide code/law states any property owner who has a massive tree on their property is solely responsible and libel for making sure those branches don’t encroach or cross a property boundary onto another owner’s lot

    1. Also do not stay at the Candlewood Suites at 4 Military Heights Drive in Roswell,NM if you rely on or really need the WiFi.
We stayed there three days and the shit hardly ever worked. Would not connect or disconnect losing all the work you had done!!
They gave us the IHG Hotel phone number 866-978-8276 to get it fixed but the rep was clueless. Candlewood Suites advertised
reliable internet/WiFi connectivity, but is was unreliable slow and just overall SUCKED.

Stella the housekeeper from Rumania was the best. We love her!

It is possible that a lawsuit against NMDOT similar to legal case filed by the family of Michael Ponce against Oilfield Outfitters and Eagle River Energy Services for the devastating and tragic crash that killed the 39 year old Ponce. Adrian Hedden's excellent reportage in the Carlsbad newspaper addresses the nature of the litigation and the lawyers that could suck the most money out of the defendants.

Law firm of will ferguson and rowe and lerner have proven effective as high quality ambulance chasers. A friend even won a large settlement involving talcum powder. Something to do with vaginal infection or odor or something ridiculous like that!!!!!

  4. Does anyone here actually live in Roswell New Mexico? If so, drive by 113 West Deming and let me know if homeowners have made an effort to cut the branches of the tree ON THEIR PROPERTY in order to avoid deadly vehicle crashes because of their selfish inattention to the lives of the people in Alien City.

IF NOT, please contact Moll Law Group in Chicago. This group of knowledgeable lawyers and attorneys will come down and do would the code enforcement entity in Chaves County should HAVE DONE LONG AGO!!!

THIS IS A SIGNIFICANT personal injury settlement just waiting to happen!!! You country bumpkins down there don't know the meaning of Aggressive Advocacy until you have seen these badass litigators in action!!!!!! Their unrelenting beeline towards an astronomical settlement will make your head spin!!

    1. I live in Sacramento, California and believe that Judge Richard Vlavianos is way too soft on drunk drivers,DWI, DUI. The problem you seem to have in Roswell is you could be stone sober and still get wasted at that woman's house in the picture!!! Why doesn't the city fine her for her obvious negligence and disregard for her neighbors and parents on the way to school etc?!?!?!?!?

Brian Beasley, Tammy Burns, Debra Zaragoza, Rodolfo Medrano Chantal Aragon should all move to liberal San Joaquin County where that bleeding heart judge will kiss their asses while they commit vehicular homicide. Woman in picture should be charged with aiding and abetting murder if she DOES NOT GET OFF HER NAGGING ASS AND trim or cut down that friggin dangerous tree ON HER PROPERTY built in 1958

  5. My nephew hired a San Antonio attorney from Carabin Shaw and won a significant amount of money for disfigurement he suffered in a motorcycle crash caused by massive amounts of vegetation and vines obscuring a traffic light near the corner of the homeowners lot.

The legal case Fretwell v. Chaffin, 652 S.W.2d 755 (Tenn.,1983) protects the city from these type of lawsuits BUT NOT THE OWNER OF THE HOME so Miss Fuentes better start cutting and trimming or she will regret it!!

Maura Ammenheuser pointed out that Hemet City Attorney Eric Vail might be mistaken when he said homeowner is not responsible for keeping plant life on their property from encroaching near signage or traffic lights.

Amir Tikriti also added some illuminating commentary on how to aggressively prosecute careless and thoughtless homeowners.

    1. PI attorney John Sloan would take this case if he knew about it.

He was the chief litigator for motorists and pedestrians at the intersection of 98th Street and Volcano Road in Albuquerque. It is much more than a problem spot. IMelissa Hollingshead avoids it like the plague and wonders why the city has not addressed this enormous safety issue

  6. NYC citizen Bill Lyons illuminates the perils and injurious effects of vegetation overgrowth and its threats to human life

Some of the stop signs at intersections near and along Wainwright and Pompey Avenues in Eltingville are obscured/blocked by tree branches. It's not an isolated situation. In fact, it is quite widespread!! Taking a drive on Staten Island streets reveals branches and overgrowth blocking road signs in and around the borough. These hidden signs pose a danger to drivers and pedestrians equally.
If you see a dangerous overgrowth problem, let us know in the comment field so we can investigate and report to city authorities. Only way lawbreakers often respond is to have fines or lawsuits based on legitimate complaints!!!!!!

Doctor Delma Fuentes saved my marriage from a husband who was banging a different college girl weekly at river walk! She, not just as well educated LMFT, made it clear that a woman should NEVER let some dog of man ruin her self image!!

I am starting to see why sooo many women are Lesbians. San Antonio is a lot more tolerant regarding gay women than it used to be.

    3. An attorney in Rio Rancho who is employed by Will Ferguson did us proud when our nephew was paralyzed for life because big trees were actually sort of wrapped around a stop sign causing a horrible maiming crash. Homeowner did not answer door when my brother tried to confront them about their negligence. He noticed code enforcement notices on the door warning negligent homeowner to do something about the branches that also could fall on pedestrians or motorcycles or cars or anything else.

You have a picture of that house with the lady standing out in front yard on sidewalk. That seems like it would be enough proof to arrest her if she does not trim or cut down the damn tree!!!

Bradley J. Winkelbauer, a civil engineer from Nebraska, has studied the killer tree problem for a big percentage of his professional life. Conron, C.E., Silvestri, C., and Ray, M.H have added much to legal remedies involving dangerous trees.

AMY BENTLEY shed some light on legal liability Ron Fluitt of Yucaipa ask the tough questions regarding who should prune the branches of lethal intersection obstructing trees.

  8. Deming is just a dangerous street even without irresponsible people WHO DO NOT MAITAIN their property like the woman in the picture.

Clark Wolf died on Deming after driving drunk. It was the usual blunt trauma as cause of death. RPD Seargant Jimmy Preston could tell you more about yet another DWI related tragedy.

  9. Rosemead California is stricter than Chaves County. A lot of thoughtless inconsiderate law breaking tenants who do not honor landlord leases which are completely fair. Code enforcement will sometimes ask renters even though part of the problem is slumlords who do not maintain livable property
